Trading in cryptocurrencies and non-fungible tokens (NFTs) has taken hold of businesses and individuals alike as an exciting new area for investment, pushing the overall market cap of cryptocurrencies to $3 trillion in November. 

 

Crypto-exchanges and their regulatory regimes are in a critical period of transition. While investors can access a platform anywhere in the world, service providers, or their regulators, are not equal in terms of investor protection – for example their ability to freeze client accounts and appropriately conduct internal investigations.

 

For example, the developer behind a recent NFT project, 'Evil Ape,' suddenly disappeared along with its Twitter account and website, siphoning off $2.7 million of investor funds in the process. Reuniting those who have fallen victim to this fraud with their money can be a long and challenging process, often involving collaboration between crypto exchanges or marketplaces, law enforcement and legal representatives — and requiring specialist insight and substantial technical and legal experience.

Tom Spiller OBE

Senior Associate, Rosenblatt

Tom Spiller is a Senior Associate in the Dispute Resolution team at Rosenblatt Law. Tom has extensive experience of acting in multi-jurisdictional, high value commercial disputes, regulatory matters and investigations. Recently, he acted for an investor in cryptocurrency who had unwittingly fallen foul of a highly sophisticated and plausible $70m Ponzi scheme and advised a leading financial institution in a £1.5bn claim brought by a foreign tax authority, involving complex litigation in multiple jurisdictions.

Joe McGill

Member, TRM Global Investigations

Joe McGill is a member of the TRM Global Investigations team. He previously served was a criminal investigator with the US Postal Service's Office of Inspector General (USPS/OIG), where he investigated financial crimes. In this capacity, he was assigned to the USSS Electronic Crimes Task Force (ECTF) where he ran darknet targeting efforts and digital currency investigations. In 2018, McGill was a finalist for US Secret Service Special Agent of the Year.
